Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Digital Training Solutions ("DTS," "we," "us," or "our"). These Terms govern your use of our mobile applications, websites, and related services (collectively, the "Services").

By downloading, installing, or using any of our applications, including but not limited to LACoFD Promotional App, FireSimulator.IO, FocusLift, and LA County Paramedic, you confirm that you are at least 13 years of age and accept these Terms.

2. License to Use

Subject to these Terms, DTS grants you a limited, non-exclusive, non-transferable, revocable license to use our Services for your personal and internal professional use.

You may not:

• Copy, modify, distribute, or reverse-engineer any part of our Services.
• Use our Services to build a competing product or service.
• Sublicense, sell, or transfer your access rights to any third party.
• Attempt to bypass, disable, or interfere with security features of the Services.
• Use automated tools (scrapers, bots) to access or extract content from our Services without written permission.

3. Subscriptions and Payments

Certain features within our applications require a paid subscription. By subscribing, you agree to the following:

• Subscriptions are billed on a recurring basis (monthly or annually) as disclosed at the time of purchase.
• All purchases are processed through Apple App Store or Google Play and are subject to their respective terms. We use RevenueCat to manage and validate subscriptions; we do not store raw payment card data.
• Subscription fees are non-refundable except as required by law or as explicitly stated at the time of purchase.
• You may cancel your subscription at any time through your platform's subscription management settings. Cancellation takes effect at the end of the current billing period.
• DTS reserves the right to modify subscription prices with reasonable advance notice.

4. User Accounts

To access certain features, you may need to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.
• Notifying us immediately of any unauthorized use of your account.

DTS reserves the right to suspend or terminate accounts that violate these Terms.

5. Content and AI Features

Our applications include AI-powered chat assistants and training content. You acknowledge:

• Training materials, quiz content, and protocols are provided for educational purposes and may not reflect the most current policies or regulations.
• DTS makes no warranty that content is accurate, complete, or up to date.
• You are solely responsible for verifying any information before acting on it in a professional capacity.

6. Prohibited Conduct

You agree not to use our Services to:

• Violate any applicable laws or regulations.
• Harass, threaten, or harm other users.
• Transmit malware, viruses, or any malicious code.
• Misrepresent your identity or affiliation.
• Collect or harvest data about other users without consent.
• Engage in any conduct that disrupts or interferes with the Services.

7. Intellectual Property

All content, trademarks, logos, and intellectual property within our Services, including app designs, training content, quiz databases, and branding, are owned by or licensed to Digital Training Solutions. Nothing in these Terms grants you any right to use our intellectual property without our prior written consent.

8. Disclaimers and Limitation of Liability

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, DTS DISCLAIMS ALL WARRANTIES INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL DTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF DTS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Indemnification

You agree to indemnify, defend, and hold harmless DTS and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Los Angeles County, California.

11. Changes to Terms

DTS reserves the right to update these Terms at any time. We will notify you of material changes via in-app notification or email. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the updated Terms.
